Four Pleaded Guilty to Healthcare Offenses, Including Doctors and Lab Owners

Mark Rubin, Renee Field, Kelly Nelson, and Carlos Hornedo were all charged with felonies in 2023 and have each pleaded guilty to those charges. Rubin and Hornedo pleaded guilty to one count of conspiracy to solicit and receive illegal kickbacks. Field and Nelson both pleaded guilty to one count of conspiracy to pay and receive healthcare kickbacks. Rubin, a pain management doctor, and Hornedo, a medical doctor, each ordered toxicology tests at specific labs for kickbacks. Medicare and other federal healthcare programs were billed for tests at three labs. Rubin received $330,000. Dr. Hornedo received approximately $412,000 in kickbacks, $45,000 in lease payments, $109,000 in medical advisor payments, and ownership shares of one of the labs involved in the scheme. The defendants each face a maximum penalty of not more than five years in federal prison, a $250,000 fine, and may be ordered to pay restitution. The VA OIG, the FBI, the Defense Criminal Investigative Service, and the Department of Health and Human Services’ Office of Investigations investigated this case.
